Since 1989 Mr. McNamara has participated in hundreds of cases that required deep negotiations prior to resolution. The primary theory underlying negotiation strategy is knowledge of litigation results and the underlying costs for both parties. Almost always the results are better when corporate counsel has deep litigation experience. The costs are always reduced when disputes are settled. This costs benefit can be obtained with private retained corporate counsel in a filed lawsuit or when an expensive situation is leading towards litigation.
